Consideration Guidance Further information Relevant period The defendant should calculate the date when the relevant period expires for accepting the claimant’s Part 36 offer, which must be no less than 21 days from when the Part 36 offer was served (CPR 36.5(1)(c)).It is important to note this date because there may be costs consequences for late acceptance of the claimant’s Part 36 offer. Insolvent estates and bankrupt beneficiaries Test of insolvency Section 421(4) of the Insolvency Act 1986 (IA 1986) provides a statutory test to establish whether an estate is insolvent: the estate of a deceased person is insolvent if, when all assets are realised, it will be insufficient to meet in full all the debts and other liabilities to which the estate is subject. An estate is not insolvent if debts and liabilities can be settled even if none of the legacies can be paid. In an insolvent estate, the beneficiaries will receive nothing and the debts and liabilities will not be paid in full, if at all. For example, Elizabeth’s estate contains just one bank account with a balance of £50,000. Dispute Resolution analysis: The minutes of the CPR Committee (CPRC) meeting of 4 October 2024 (conducted in a hybrid format at The Rolls Building (Royal Courts of Justice) and via video conference) cover a number of issues including proposed amendments to the Pre-Action Protocol for Personal Injury Claims below the Small Claims Limit in Road Traffic Accidents and CPR PD 27B. Amendments to CPR 25 (interim remedies and security for costs), CPR 42 (change of solicitor), CPR 46 (costs orders in favour of or against non-parties) and CPR PD 52E (appeals by way of case stated) were also considered. Discussion ensued on the small claims paper determination pilot scheme, guidance on emailing the court and costs budgeting light.

The effect of post-action misconduct on the default provisions of discontinuance (Elphicke v Times Media Ltd)

Dispute Resolution analysis: The claimant, a former member of parliament, sued the defendant for damage to his reputation as a result of alleged defamatory statements made. The claimant discontinued his claim before trial and sought to disapply the default position under CPR 38.6(1) that a discontinuing claimant will be liable for the successful defendant’s costs. It was necessary for Master McCloud to consider whether the court’s discretion could and should be applied. The court considered the circumstances in which the default position could be departed from and the level of conduct that would be required to justify such a departure from the usual rule. The issue of conduct which takes place after proceedings and whether this fell within the jurisdiction of the court was also considered.
